1. Introduction
1.1 Definition of the Company and the Service Offered
MXTERA (CNPJ: 58.685.365/0001-87), hereinafter referred to as "we", "our" or "the company", is a sales intermediation platform that acts as a facilitator between buyers and sellers of virtual items, digital goods and online game accounts.

Our goal is to provide a safe, reliable and transparent environment for users to carry out transactions of digital goods. MXTERA's activities are limited to intermediation: we are not the owners or direct sellers of the items offered, nor do we guarantee their quality, legality or suitability for a specific purpose, except when expressly indicated.

The services offered include, but are not limited to:

Creation of product listings and accounts;
Payment intermediation, using recognized payment providers;
Technical and operational support to the customer;
Implementation of measures to ensure the security and integrity of transactions carried out on our platform.
All operations of MXTERA are based on Brazilian legislation, including the Consumer Protection Code (Law 8,078/1990), the Civil Code (Law 10,406/2002) and other relevant regulatory standards.

1.2 Acceptance of Terms
By accessing, browsing or using the MXTERA website, you (hereinafter "user") declare that you have read, understood and agree to comply with these Terms of Service, as well as our Privacy Policy, which is an integral part of this document. If you do not agree with any condition described herein, you must immediately stop using the platform.

By using the website, you represent and warrant that:

Age: You are over 18 years old or, if you are between 16 and 18 years old, you have the proper authorization from a legal guardian to use our services, and you are aware that this guardian will be responsible for your actions on the platform.
Legal Capacity: You have full legal capacity and are not prevented, by law or court order, from carrying out financial transactions.
Truthfulness and Update of Information: The information provided in your registration is true, complete and up to date.
Compliance with Law: You undertake to use our services in accordance with all applicable laws and regulations, including, but not limited to, consumer and tax legislation.
Failure to comply with any of these statements may result in the suspension or cancellation of access to the platform, without prejudice to legal liabilities.

1.3 Updating the Terms and Notifications
MXTERA may review, modify or update the Terms of Service periodically to reflect legal changes, operational improvements or business needs. Changes will be published on the website and, whenever possible, we will notify users via registered email or other communication channels.

The new terms will come into effect after [15 days] from the date of publication. Continued use of the platform after this period will be considered automatic acceptance of the updates. If the user disagrees with any change, they may immediately stop using the platform and request the closure of their account.

1.4 Jurisdiction and Applicable Legislation
This agreement is governed exclusively by the laws of the Federative Republic of Brazil, in particular:

Consumer Defense Code (Law 8,078/1990), applicable to relations between consumers and MXTERA;

Civil Code (Law 10,406/2002), regarding contractual obligations and rights;

Other regulatory standards for consumer protection and e-commerce.
For the resolution of any disputes arising from this contract, the jurisdiction of the district of São José de Piranhas-PB is elected, unless otherwise determined by current legislation.

2. Purpose of the Service
2.1 Description of the Intermediation Service
MXTERA's main purpose is to act as a sales intermediation platform, offering a safe, efficient and transparent environment where buyers and sellers can transact virtual items and game accounts.

Through our website, users have access to the following features:

List Products: Sellers can create detailed ads for their digital items, including descriptions, prices, sales conditions and other relevant information. These ads are displayed to potential buyers in an intuitive and easy-to-navigate interface.
Make Purchases: Buyers can explore available items, compare offers and make purchases quickly and securely, using reliable payment systems integrated into the platform.
Security Guarantee: We implement advanced technology, including encryption and identity verification (KYC - Know Your Customer), to minimize the risk of fraud and protect our users' sensitive data and information.
Customer Support: We provide support to resolve questions, offer technical assistance, mediate disputes and provide guidance at any stage of the purchase and sale process.
MXTERA does not have direct control over the products listed on the platform, and the seller is solely responsible for the accuracy of the information presented. The company acts exclusively as an intermediary, facilitating the negotiation and promoting security in the process.

2.2 Nature of Virtual Items
Items sold through the platform include, but are not limited to:

Game accounts;
Virtual currencies;
Digital goods and items usable on electronic platforms and games.
Buyers and sellers should be aware of the following:

Immediate Use: Digital goods purchased are generally available for immediate use after payment confirmation. Due to the nature of these products, the right to withdrawal provided for in article 49 of the Consumer Defense Code may have exceptions, provided that the product is used or consumed irreversibly before the end of the 7 (seven) day period.
Non-Reversible Transactions: Purchases of virtual items are considered final, except for defects, non-delivery or proven irregularities. Therefore, returns and refunds may not apply to goods consumed or transferred to the buyer.
Ownership and Licensing: Some items, such as game accounts, may be subject to the Terms of Service of the platforms of origin. By purchasing such items, the buyer assumes full responsibility for their use in accordance with the rules of the game developer or supplier, and MXTERA is not responsible for any penalties arising from irregular use or use in disagreement with these rules.
2.3 Commitment to Legislation
MXTERA is committed to operating in full compliance with Brazilian and international laws applicable to e-commerce, including, but not limited to:

Consumer Defense Code (Law 8.078/1990): We guarantee protection for consumer relations, applying the rules applicable to consumer rights and providing adequate support in cases of disputes.
Electronic Commerce Law (Decree 7,962/2013): We comply with specific standards for transactions carried out in the virtual environment, including providing clear and accessible information about the service, prices and conditions.
General Data Protection Law (LGPD - Law 13,709/2018): We guarantee the protection and appropriate use of personal data provided by our users, in accordance with the principles of security and privacy.
Other tax laws: We undertake to operate in accordance with the tax regulations applicable to the intermediation and marketing of digital goods.
It is the responsibility of sellers to ensure that their items and practices comply with the laws and regulations of the games and platforms from which the items derive, as well as the applicable legislation in Brazil.

3. Registration and User Account
3.1 Registration Process
To use MXTERA services, users must register on the platform, agreeing to provide accurate and complete information during the process. The steps include:

Account Creation: The user must provide mandatory information, such as full name, valid email address, telephone number and create a strong and secure password. The responsibility for keeping the password confidential lies solely with the user.
Number Confirmation: After completing the registration, a message will be sent with a code to activate the account. Only after this activation will full access to the services be available.
Compliance and Data Update: By registering, the user declares that all information provided is true, accurate and current. They also assume responsibility for keeping the data updated, especially in cases of changes to email or other essential information.
3.2 User Responsibility for Maintaining Account Security
The security of the account is the sole responsibility of the user. To prevent security breaches, the following measures are necessary:

Credential Protection: The user should not share their password or access credentials with third parties. In addition, it is recommended to change the password periodically to reduce the risk of unauthorized access.

Immediate Notification of Suspicious Activities: In case of suspicion or confirmation of unauthorized use of the account, the user must immediately inform MXTERA. The company will take measures to suspend or protect the account against fraudulent activities.

Responsibility for Actions Performed: All actions performed through the registered account are the sole responsibility of the user, including financial transactions and communication with other users. MXTERA is not responsible for losses or damages resulting from the user's negligence in protecting their credentials.

3.3 Identity Verification (KYC)
As part of MXTERA's commitment to creating a safe environment for buyers and sellers, identity verification (KYC - Know Your Customer) may be required.

Information Collection: During the registration process or when making transactions, MXTERA may request additional documents, such as:
Official identification document with photo (RG, CNH or Passport);
Recent proof of residence;
Other information necessary to validate the user's identity.
Purpose of Verification: The purpose of KYC is to prevent fraud, guarantee the legitimacy of all users and ensure compliance with applicable Brazilian and international laws. This process protects both buyers and sellers, promoting security and trust within the platform.
Privacy and Data Protection: All information collected during KYC will be treated confidentially, in accordance with the General Data Protection Law (LGPD) and our Privacy Policy. The data will be used exclusively for identity verification and security, and will be stored securely and encrypted, with restricted access.

4. User Obligations
4.1 Proper Use of the Platform
Compliance with Laws:
The user agrees to use the MXTERA platform in accordance with all applicable laws, including, but not limited to, national and international laws, e-commerce regulations, personal data protection, intellectual property rights and consumer protection guidelines set forth in the Consumer Protection Code (CDC).
Suggested change: The platform must be used in accordance with the current legal system, respecting, in addition to civil, commercial and contractual obligations, the rights provided for in Brazilian consumer protection legislation, as guaranteed by the Consumer Protection Code (Law No. 8,078/1990).

Personal Use:
The MXTERA platform is exclusively for the personal use of its users and may not be used for commercial purposes without the express prior written authorization of the company. This includes, but is not limited to, the resale, distribution, sale of products, or any other form of commercial exploitation without due authorization.

Respectful Interaction:
The user agrees to interact with other members of the MXTERA community in an ethical and respectful manner, refraining from adopting behaviors that may be considered offensive, harmful, discriminatory or abusive, including the use of language that incites hatred or disrespect towards third parties.

4.2 Prohibition of Fraudulent or Illegal Activities
Fraud:
It is strictly forbidden to carry out any type of fraud on the platform, including the creation of fake accounts, the publication of products that do not exist or the manipulation of the payment process, a practice that may result, depending on the severity, in account blocking, in addition to applicable legal actions, as determined by Brazilian law.

Illegal Activities:
The user agrees not to use MXTERA to promote, sell, purchase or distribute products or services that are illegal, fraudulent or that violate current legislation, including, but not limited to, activities related to piracy, sales of counterfeit products, or any form of violation of third party intellectual property rights.

Sale of Illegal Items:
The sale of any item that is considered illegal, restricted, prohibited or that infringes intellectual property rights of any kind, under the terms of the applicable legislation in any jurisdiction, is prohibited, under penalty of civil and criminal liability.

Suggested addition for greater legal certainty:
The user who performs any of the actions described herein will be subject to immediate account cancellation and legal proceedings according to the nature of the violation, as provided for in articles 186 and 927 of the Brazilian Civil Code.

4.3 Responsibility for Information Provided
Accuracy of Data:
The user is responsible for providing truthful, correct and complete information when registering on the platform, as stipulated by the Consumer Protection Code, which guarantees the protection of the consumer's information and requires that it be accurate. Any changes to the registration information must be updated immediately, in order to avoid losses to the parties involved.

Updating Information:
The user must keep their registration information updated and must immediately notify MXTERA of any changes that may occur. Failure to comply with this obligation may result in problems in the sale, purchase or other transaction process within the platform.

Consequences of False Information:
MXTERA reserves the right to suspend or cancel any account that provides false, incomplete or inaccurate information, in addition to notifying the competent authorities, when necessary. This procedure is in accordance with the obligations of good faith and transparency provided for in the Brazilian Civil Code (articles 422 and 421). Furthermore, if the user fails to provide truthful information and harms the platform or third parties, he/she will be subject to appropriate legal measures, as determined by the Consumer Protection Code.

5. Transactions and Payments
5.1 Purchase and Sale Process
Product Listing:
Sellers may list their products and/or services on the MXTERA platform and must provide clear and accurate descriptions of the items, including price, features, conditions and all relevant information. The seller is fully responsible for the accuracy and conformity of the information provided in the listings, and must ensure that there is no error or omission.
Additional suggestion:
MXTERA is not responsible for false, inaccurate or misleading information provided by sellers, and the latter is responsible for the legal consequences arising from false information, in accordance with the provisions of the Brazilian Civil Code and the Consumer Protection Code.

Completing the Purchase:
By making the purchase, the buyer will be accepting the terms and conditions of the product and the transaction, and payment must be made within the period informed at the time of purchase. The checkout process will be clearly displayed on the platform, including information about the item purchased, its total value and the payment options available.

Transaction Confirmation:
After the payment is completed, MXTERA will send a confirmation to both parties (buyer and seller), indicating all the terms of the transaction, the amount paid, the product purchased and the estimated delivery date of the item or service. MXTERA is not responsible for compliance with the agreement between the parties, except in cases where intermediation of the transaction is necessary according to the terms established in this contract.
Additional suggestion:
The transaction confirmation is a "receipt of payment" and does not, in itself, imply guarantees about the quality or delivery of the product/service, with the seller being responsible for these issues, as provided for in the Consumer Protection Code (CDC).

5.2 Service Fees
Percentage on the Transaction:
MXTERA charges a service fee on each transaction made, which will be calculated as a percentage of the total value of the transaction. The exact percentage of this fee will be previously informed to the seller and the buyer at the time of completion of the checkout, in a clear and transparent manner.
Suggested change:
The fee will be clearly informed before the purchase is finalized and will be expressed in a transparent manner in the transaction summary, as determined by the Consumer Protection Code legislation on clarity of information.

Other Fees:
MXTERA reserves the right to charge other fees that are not previously informed at the time of the transaction. In the event of the insertion of new charges or fees, users will be immediately informed before any future transaction is carried out.
Suggested addition:
New fees will be communicated in a detailed and transparent manner to users at least 30 (thirty) days in advance, in accordance with the good practices provided for by the Consumer Protection Code.

5.3 Accepted Payment Methods
MXTERA offers multiple payment options for the convenience of its users, which can be modified or expanded as needed. The options currently accepted include, but are not limited to:

Credit and Debit Cards:
Payments made using credit and debit cards from financial institutions that operate securely and comply with electronic transaction security standards are accepted.

PayPal:
The platform also offers integration with PayPal, allowing for fast, secure payments with the protection guaranteed by this platform.

Cryptocurrencies:
MXTERA accepts cryptocurrencies as a payment method, however, according to current legislation, this service is subject to government regulations and may be limited to certain jurisdictions.

Other Payment Methods:
MXTERA may add other payment options over time. If new alternatives are offered, they will be communicated in detail to users through the platform in advance. Suggested addition:
Payment methods are subject to compliance with Brazilian laws, especially with regard to consumer protection and tax legislation, and MXTERA will ensure that all payment methods comply with applicable legislation, including security and financial data protection standards.

6. Refund and Return Policy
6.1 Conditions for Refunds
MXTERA acknowledges that, in some situations, the buyer may request a refund. However, due to the nature of the products offered on the platform, the refund policy follows the guidelines below, as stipulated by Brazilian law:

Deadline for Refund Request:
The buyer may request a refund within a specific period after the transaction. This period will be clearly indicated on the platform and may vary depending on the type of product, respecting the terms and conditions of each item category. The period may not be less than 7 (seven) calendar days, as established by the Consumer Defense Code for purchases made outside the commercial establishment (art. 49 of the CDC).

Request Analysis:
All refund requests will be evaluated by the MXTERA team. The refund may be granted if the buyer meets the conditions below:

The item was not used or transferred to another account.
The purchased product does not comply with the description or was delivered improperly, with defects or in conditions not expected.
Additional suggestion:
The refund request will be denied in cases of violation of the terms of use, use of virtual items or if the product is not defective and the consumer has previously agreed to the nature of the digital goods.

6.2 Clarification on the Nature of Virtual Goods
Due to the digital nature of the items sold on the platform, it is essential to clarify certain aspects regarding virtual goods, as provided by Brazilian legislation:

Immediate Use:
Virtual goods, such as game accounts, digital currencies and other items, are made available for immediate use after payment confirmation. After the item has been used, it cannot be returned or refunded, in accordance with the legislation that regulates digital goods.

Impossibility of Return:
Virtual goods, due to their digital nature, are not subject to return or refund, except for specific legal exceptions. The Consumer Defense Code provides that the right of withdrawal does not apply to contracts related to the supply of digital content that, when provided with the consumer's prior consent, is accessed or consumed immediately, or in audiovisual content, which includes digital items or services used for games, according to art. 49 of the CDC.

Acknowledgement by the Consumer:
The buyer acknowledges and agrees that, when purchasing a digital good, he or she is aware of the nature of this product and the implications of its immediate use. As a result, once the item is used or transferred, MXTERA will not be obliged to provide a refund, except in cases of evident error in the description, or defects in the product purchased that make the good unsuitable for its use.

Exceptions:
In specific situations, such as an error in the product description or failure to deliver the item, MXTERA may evaluate the case and propose alternative solutions to the consumer, such as:

Credit on the platform for future purchases.

Refund, when applicable, under the conditions described in this Policy.
Each case will be analyzed individually to ensure that consumer rights are respected, in accordance with the principles of the Consumer Defense Code.

7. Intellectual Property Rights
7.1 Acknowledgement of MXTERA’s Intellectual Property Rights
MXTERA owns all intellectual property rights related to its platform, including, but not limited to:

Trademarks:
All trademarks, logos, trade names, designs and other distinctive signs used on the platform are the exclusive property of MXTERA or are licensed for their use. Unauthorized use of any MXTERA trademark constitutes a violation of its intellectual property rights and is strictly prohibited.

Platform Content:
The content, design, texts, graphics, logos, images, software, source code, videos and other materials made available on the platform are protected by copyright and other applicable intellectual property laws. The user agrees not to reproduce, modify, distribute, display or create derivative works based on any part of MXTERA’s content, unless expressly authorized by the company.

Content Licensing:
MXTERA grants the user, on a non-exclusive, non-transferable and revocable basis, a limited license to access and use the content made available on the platform, exclusively for personal and non-commercial purposes, in accordance with the terms of this agreement.

7.2 Acknowledgement of Suppliers' Intellectual Property Rights
Users acknowledge and agree to respect the intellectual property rights of third parties, including, but not limited to:

Virtual Goods and Game Accounts:
Virtual items, such as game accounts, digital currencies and other products offered on the platform may be subject to the intellectual property rights of their respective owners. The user agrees not to violate these rights, including not to carry out the unauthorized reproduction, distribution or exploitation of these goods, whether through sale, distribution or any other type of commercial use.

Licensing and Use of Supplier Products:
The use of products and services offered by suppliers on the platform is subject to the licensing terms and other requirements established by the suppliers of such goods. The user is responsible for ensuring that any actions relating to goods purchased on the platform do not infringe the intellectual property rights of suppliers and are in accordance with the terms agreed with them.

7.3 Consequences of Violation of Intellectual Property Rights
Any violation of the intellectual property rights of MXTERA or third parties may result in legal liability for the infringing user. MXTERA reserves the right to take the necessary measures to protect its rights, including, but not limited to:

Temporary or permanent suspension of the infringing user's account.

Blocking access to the platform.

Adoption of appropriate legal measures, including, but not limited to, action for material and moral damages, as provided for in Law No. 9,610/98 (Copyright Law) and Law No. 9,279/96 (Industrial Property Law).
MXTERA may also, at its discretion, take other administrative or technical measures to prevent unauthorized use of its intellectual property.

8. Limitation of Liability
8.1 Exemption from Liability for Technical or Security Problems
MXTERA is committed to keeping its platform secure and functioning properly, but cannot guarantee the total absence of errors. Therefore, the company is exempt from liability for technical problems that may occur, including, but not limited to:

Service Interruptions:
MXTERA is not responsible for interruptions or failures in the platform service caused by software errors, hardware failures, internet connectivity problems, cases of force majeure or any other event that may temporarily or permanently prevent access to or use of the platform.

Data Security:
Despite implementing security measures to protect user information, MXTERA cannot guarantee absolute security of information transmitted over the internet, recognizing the risks inherent to the virtual environment. The user assumes responsibility for any damages resulting from unauthorized access, invasions or failures in the devices used, as well as for the confidentiality of their access credentials (such as login and password).

Third Party Data Liability:
MXTERA also disclaims any liability related to damages caused by information, data or products provided by users, or by errors, fraud or omissions of third parties on the platform.

8.2 Limitation on Cases of Disputes between Users
MXTERA acts as an intermediary platform, allowing buyers and sellers to negotiate directly with each other. The company does not get involved in the transactions, being responsible only for mediating between the parties, and, therefore, is not responsible for:

Transaction Disputes:
MXTERA is not responsible for losses, damages or liabilities arising from disputes between users, including, but not limited to, disagreements about product delivery, quality, conformity to descriptions, or any other aspect of the transaction. All conditions of purchase, delivery and product support must be agreed upon between the parties involved.

Indirect Liability:
MXTERA shall not be liable for indirect, incidental, special or consequential damages that may arise due to the use, or inability to use, its platform, even if the company has been previously advised of the possibility of such damages. MXTERA's liability, if any, shall be limited to the amount paid for the transaction directly involved in the dispute, under the terms provided for in Brazilian law.

8.3 Acceptance of Limitations
By using the platform, the user agrees to exempt MXTERA from any liability related to technical or security problems or disputes that may occur between users, recognizing the nature and limits of the platform's liability. The user declares to be aware of the limitations expressed in these Terms of Service, which he/she considers reasonable and acceptable in the context of the use of the platform.

9. Dispute Resolution
9.1 Process for Resolving Disputes
MXTERA acts as an intermediary for payments made on the platform. Therefore, any and all disputes related to transactions involving buyers and sellers must be resolved between the buyer and MXTERA, with MXTERA being responsible for mediating these disputes.

Notification:
If the buyer or seller identifies any problem in the transaction (such as delivery failures, problems with the product description, among others), the affected party must notify MXTERA in a clear and documented manner. The dispute must be opened directly on the platform (MXTERA offers a dedicated system for this purpose), and it is not necessary, in the first instance, to use a credit card or external methods.

Dispute Analysis:
After receiving the dispute, MXTERA will analyze the evidence presented, such as: proof of delivery, proof of product defect or failure in the description, as the case may be. Both parties may provide information or evidence (such as screenshots, screen recordings, emails or videos) to support their claim. The analysis will be conducted impartially and transparently.

Dispute Resolution:
MXTERA will take the necessary measures, in accordance with the platform rules and refund policy, to resolve the issue. This may include:

Refunding the payment to the buyer (if there is a proven error in the transaction);
Refunding the amount to the seller, if the dispute is resolved in their favor;
Alternative proposals, such as platform credits, when appropriate, to be used by the buyer or the seller.
Final Resolution:
If the parties do not reach an amicable agreement, MXTERA will make a final decision in accordance with established policies. This decision may involve negotiating a refund or another solution considered fair, based on the evidence presented.

9.2 Account Negative Status and Suspension
If the customer fails to resolve the dispute or is found to have committed fraud or bad faith, the account may be permanently negative or suspended, with MXTERA being responsible for executing this measure.

Impact on Defaulting Users:
Users who cause damage to the platform or do not resolve disputes fairly may have their access restricted, including:

Suspension of the profile until the problem is resolved;
Account cancellation and blocking of new registrations if the dispute is not resolved adequately within the deadline;
Implementation of an internal penalty system, such as restrictions on the use of platform benefits or the application of internal fines, which are not financial in nature but impact the user experience.
9.3 Indication of Competent Forum
If disputes cannot be resolved directly by MXTERA, either through mediation or other alternative channels within the platform, the jurisdiction of the district of [City, State] will be valid for legal actions related to the transaction.

9.4 Acceptance of the Terms of Resolution
By using the MXTERA platform, the user accepts and agrees to the procedures described for resolving disputes and understands that the company is committed to maintaining a safe and balanced environment for buyers and sellers. The user acknowledges that MXTERA is responsible for the resolution process and guarantees related to payment, and that he/she definitively accepts the mediation of conflicts through the platform, as the primary and exclusive method of resolving disputes.

10. Changes to the Terms
10.1 The Company's Right to Modify the Terms
MXTERA reserves the right to modify, alter or update these Terms of Service at any time, as it sees fit or needs, including, but not limited to, changes due to:

Changes in Brazilian legislation, especially with regard to the Consumer Defense Code (CDC), civil provisions or other regulations pertinent to e-commerce;
Changes in best market practices, in order to improve the user experience;
Feedback from users or operational adjustments, in order to improve the services provided.
Changes to the Terms of Service will come into effect from the date of publication on the platform or notification to the user, as stipulated in this section.

10.2 Notification to Users of Changes
Whenever there are substantial modifications to this agreement, MXTERA undertakes to notify users of significant changes to the Terms of Service. This notification will be sent via:

Direct notice on the platform (when accessing the account);
Email registered by the user, when applicable.
The notification will include a clear description of the changes made and the time frame in which such changes will come into effect.

10.3 Responsibility of Users
It is the responsibility of users to periodically review the Terms of Service in order to stay up to date with any changes. Continued use of the platform, after the publication of modifications to the Terms of Service, will be considered as tacit acceptance of the new Terms.

If the user does not agree with any change, he/she has the option to close his/her account and stop using MXTERA services before the effective date of the changes. If he/she continues to use the platform after this period, he/she will be bound by the new conditions.

10.4 Final Provisions
If any provision of the amended Terms of Service is considered invalid or unenforceable according to the legislation in force, the remaining provisions will remain in force, being revised as necessary, in order to guarantee the general effectiveness of the contract.

12. Final Provisions
12.1 Validity and Effectiveness of the Terms
If any provision of these Terms of Service is found to be invalid, illegal or unenforceable by a competent court, such provision shall be deemed severable and shall not affect the validity of the remaining clauses, which shall remain in full force and effect. The invalidity or unenforceability of a clause shall not compromise the validity and enforceability of the remaining provisions.

12.2 Modification and Assignment
MXTERA may assign, transfer or delegate, in whole or in part, its rights and obligations arising from these Terms of Service to third parties, at its sole discretion, without the need for prior notice to users. The user may not assign, transfer or in any way dispose of its rights and obligations arising from this agreement without the prior and express written consent of MXTERA.

12.3 Applicable Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any dispute arising from this agreement that cannot be resolved amicably or through the mediation and arbitration methods provided for in the corresponding section shall be submitted to the jurisdiction of the district of São José de Piranhas-PB, with the parties waiving any other jurisdiction, however privileged it may be, under the terms of the Consumer Protection Code (CDC) and other relevant legislation.

12.4 Integration
These Terms of Service constitute the entire agreement between the user and MXTERA regarding the use of the platform and replace all prior agreements or understandings, whether oral or written, related to the same subject matter. No other condition or provision, whether oral or written, that is not expressly established in these Terms shall be considered valid, unless agreed upon by both parties through a formal amendment.
